Name of the service: OptimÚt
Hosting provider: Hetzner Online GmbH (Industriestr. 25, 91710 Gunzenhausen, Germany) — the servers are located within the European Union (Germany).
1. Definitions
Service: the web application named OptimÚt, which produces an estimate of the expected toll/motorway-vignette cost, fuel cost, and — based on optionally supplied data — the vehicle's wear/depreciation cost for a route (origin–destination) entered by the user, and compares the available route alternatives (fastest, economical, toll-free).
User: any natural or legal person who uses the Service, either anonymously (with a limited number of lookups) or after registering.
Consumer: a User who is a natural person acting outside their trade, business, or profession.
Credit: a non-monetary accounting unit within the Service that entitles the holder to a route check (lookup) — 1 credit is consumed per route check.
2. Subject of the service
The Service Provider operates an online cost-estimation and route-comparison tool that calculates estimates from publicly available map and toll data, and from the currently published, official Hungarian motorway-vignette price list. The Service:
- can be used free of charge, without registration, for up to 5 lookups per device/browser session;
- after registration, allows the User to enter their own vehicle data (consumption, fuel price, existing vignettes) for a more precise estimate, save favourite routes, and perform further lookups up to their current credit balance;
- grants some credits free of charge for registering and for certain in-app activity (e.g. regular use, completing goals, inviting a friend); further credits can be purchased as described in Section 4.
The business (B2B) features of the Service (e.g. the quote calculator, a custom pricing profile) are available optionally, at the User's own choice, and do not constitute a separate, paid service.
3. Registration, user account
Registration is done by providing an e-mail address and a password, and by accepting these Terms of Service and the Privacy Notice. By registering, the User enters into a contract with the Service Provider under the terms of these Terms of Service.
The User must provide a genuine e-mail address and keep their password confidential. The User is responsible for all activity carried out through their account, unless that activity resulted from unauthorised use of the account of which the User promptly notified the Service Provider.
The User may request the deletion of their account and the associated data at any time, without giving reasons — either directly through the "Delete account" self-service action under "My data" in the Service (confirmed by re-entering the password), or by e-mailing varga.fabian.gyorgy@gmail.com. Deletion does not entitle the User to a refund of unused, already-purchased credits; the settlement of purchased, unused credits is governed by Sections 4–5.
4. Credits, fees, payment
The current price and quantity of each credit package are shown on the "Buy credits" screen of the Service. The prices shown are gross (VAT-inclusive) prices, denominated in Hungarian forints (HUF).
Payment is processed through the hosted payment page of Barion Payment Zrt. ("Barion"), an independent payment institution supervised by the Central Bank of Hungary (MNB). The User enters their card details directly to Barion — the Service Provider never sees, receives, or has access to this data. The payment transaction itself is governed by Barion's own terms and privacy notice, available at barion.com.
Upon a successful payment, confirmed by Barion, the Service automatically and immediately credits the purchased credits to the User's balance.
If a payment fails, or the credit is not applied due to a technical error, the User may report this to the Service Provider at the e-mail address above; the Service Provider will investigate and, where justified, apply the missing credit or refund the amount paid.
5. Right of withdrawal / cancellation
Under Hungarian Government Decree 45/2014. (II. 26.) on the detailed rules of contracts between consumers and businesses — since a credit purchase qualifies as a distance contract for digital content not supplied on a tangible medium — a consumer would, as a general rule, be entitled to a 14-day right of withdrawal/cancellation without giving reasons.
However, under Section 29(1)(m) of that Decree, a consumer may not exercise this right where the business began performance with the consumer's prior, express consent, and the consumer acknowledged that this results in the loss of their right of withdrawal/cancellation. Because a purchased credit is credited and made usable immediately upon successful payment, the User expressly and in advance consents, at the time of confirming the purchase, to performance starting immediately, and simultaneously acknowledges the resulting loss of the right of withdrawal/cancellation.
Notwithstanding the above, if credited credit could not actually be used due to a fault on the Service's side, the complaint-handling/refund process under Section 4 applies.
6. Liability; the nature of the estimate
The figures shown by the Service are indicative estimates only, based on public map data, the vehicle parameters supplied (or default values) by the User, and the currently published, official vignette price list. The Service does not constitute an official toll-section record and does not replace obtaining official information about toll sections or prices.
The Service Provider accepts no liability for:
- any discrepancy between the estimate and the toll/vignette, fuel, or other cost actually incurred;
- damage arising from any inaccuracy or obsolescence of the map, route, or price-list data;
- damage arising from the temporary unavailability or malfunction of the Service, except in the case of intentional or grossly negligent conduct.
To the extent permitted by mandatory law, the Service Provider's liability is limited to the amount actually paid by the User for the relevant purchase.
7. Intellectual property
The Service's software, interface, visual identity, name, and logo are the intellectual creation of the Service Provider, or the Service Provider otherwise holds the rights thereto. Copying, distributing, or commercially exploiting them without the Service Provider's prior written consent is prohibited.
8. Availability, maintenance
The Service Provider strives for continuous availability of the Service but does not guarantee uninterrupted operation. The Service Provider reserves the right to carry out periodic maintenance and updates without prior notice.
9. User obligations
The User may not use the Service for any unlawful purpose, to the detriment of other users or the Service Provider's legitimate interests, or in a way that disrupts the Service's normal operation (e.g. automated mass querying, overloading the Service). In the event of a serious or repeated breach of these rules, the Service Provider may suspend or delete the User's account.
10. Complaints, dispute resolution
The User may report a complaint or question about the Service via the in-app "Feedback" feature, or directly by e-mail at varga.fabian.gyorgy@gmail.com. The Service Provider will investigate and substantively respond to complaints received within the statutory deadline.
If the complaint is not resolved directly, a User who is a consumer is entitled to:
- contact the competent conciliation body (békéltető testület) at their place of residence for out-of-court settlement of the consumer dispute (bodies listed at bekeltetes.hu);
- use the European Commission's Online Dispute Resolution platform for disputes arising from an online purchase within the EU (ec.europa.eu/consumers/odr);
- initiate consumer-protection proceedings at the competent consumer-protection authority (the district office) at their place of residence;
- bring the matter before the competent court.
11. Miscellaneous
Matters not regulated in these Terms of Service are governed by Hungarian law — in particular Act V of 2013 on the Civil Code, Act CLV of 1997 on Consumer Protection, and Act CVIII of 2001 on certain aspects of electronic commerce services and information society services.
The Service Provider reserves the right to unilaterally amend these Terms of Service. Users will be informed of any amendment on the Service's interface and, for registered Users, also by e-mail. The amendment takes effect from the date specified therein, following publication; credit relationships already established (e.g. purchased, credited) remain governed by the terms in effect at the time of purchase.
